Council Report - Section 94 / 7.11

A Quantity Surveyor is required to estimate the construction cost  for the council to calculate the monetary development contribution levy.

If you’re about to start a new development project with an estimated cost of $500,000 or more, you may have to pay a levy to your local council in terms of section 94 of the Environmental Planning and Assessment Act 1979.

The section 94 report process is as follows:

A Quantity Surveyor is required to estimate the construction cost based on architectural drawings for the council to calculate the monetary development contribution levy. The levy is calculated based on a percentage of the total development cost.

A section 94 report, otherwise known as the Cost Summary Report must be provided to the Council for a Development Application (DA) or the application of a Complying Development Certificate (CDC). 

When the calculated cost estimate of the development is more than $100,000 the section 94 report must be completed by a person who is suitably qualified by the Council (generally builders and architects). 

However, if the cost estimate of the new development is above $500,000, the Council may request for provision of an independent Cost Summary Report certified and provided by a registered Quantity Surveyor.

Without a Quantity Surveyor, you may end up paying higher section 94a contribution fees to the council then you need to. Or you may even run the risk of undervaluing the section 94a contribution levy  payable to the Council.

What is involved in producing a Section 94a Cost Summary Report?

  • Reviewing the plans which are to be submitted as part of the Development Application or the Complying Development Certificate application. 
  • The preparation of a cost estimate in accordance with the Australian Cost Management Manuals provided by the Australian Institute of Quantity Surveyors (AIQS).
  • Calculating the development costs per the definition of the Local Council.
  • The inclusion of GST in the calculation.
  • Measurement of Gross Floor Areas in accordance with the Method of Measurement of Building Areas in the AIQS Cost Management Manual Volume 1, Appendix A2.
  • Populating and signing the development contribution forms required by Council
  • As Quantity Surveyors registered and certified with the Australian Institute of Quantity Surveyors (AIQS), we can prepare the section 94 report in accordance with your Council’s format and requirements.
